What your notice must contain

Under 17 U.S.C. § 512(c)(3), a valid notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it — a direct URL is best.
  4. Your contact information: address, telephone number and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We remove or disable access to material that is the subject of a valid notice, and we terminate the accounts of repeat infringers where applicable.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same agent containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good faith belief it was removed by mistake, your contact information, and your consent to the jurisdiction of the federal district court for the district where you live (or the Western District of North Carolina if you are outside the United States).

Complaints about listing content may need to be directed to the listing broker or to Canopy MLS; tell us and we will point you to the right party.

Note: knowingly making a material misrepresentation in a DMCA notice or counter-notice can make you liable for damages under 17 U.S.C. § 512(f).
