How the age restriction actually worksHousing for older persons is a lawful exception under the federal Housing for Older Persons Act. The rule is set by each community’s own recorded covenants, not by the brokerage, and communities write it differently: who must be 55, who may occupy, and what happens on inheritance or on the death of a spouse.
